These Terms govern your use of the Kalpavriksha desktop application and related services ("the Service"). By installing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
Subject to these Terms, we grant you a personal, non-exclusive, revocable license to install and use the Service (transferable only as described below). Your license:
The free trial needs no payment method, so nothing is charged automatically. You are only billed if you actively upgrade. Once you upgrade, the annual subscription renews automatically at the end of each year using your saved payment method, unless you cancel first. You can cancel at any time through the customer portal (linked from your receipt email or from inside the app). When you cancel, your license stays active until the end of the current paid period and then expires. Because the trial is free and upgrading is a deliberate choice, we do not offer routine refunds. Please see our Refund & Cancellation Policy, which also covers how we handle billing errors and your statutory rights.
You agree not to reverse engineer, decompile, or try to extract source code except where the law allows; resell, sublicense, or share your license key; get around the licensing or device-binding mechanism; or use the Service to break any law. We may revoke a license that is used in breach of these Terms.
Your financial data is stored locally on your device (see our Privacy Policy). You are responsible for keeping your own backups. We are not responsible for data loss caused by device failure, deletion, lost passwords or encryption keys, or your own actions. The Service gives you backup tools, but using them is up to you.
The Service can connect to third parties when you ask it to. For example, Google Gemini for AI features (under your own API key), exchange-rate and price providers, and Stripe for payments. Your use of those services is subject to their own terms, and we are not responsible for them.
The app runs locally and keeps working offline. License validation allows a grace period if our servers are briefly unreachable. We do not guarantee uninterrupted availability of the licensing or payment services.
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, or that any calculation will be accurate for your particular circumstances.
To the maximum extent the law allows, Kalpavriksha and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or financial loss, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid for the Service in the 12 months before the claim.
You may stop using the Service at any time. We may suspend or end your license if you materially breach these Terms. When your license ends, your right to use the Service ends with it, but your locally stored data remains yours.
We may update these Terms as the product grows. If we make a meaningful change, we will post it here with a new "last updated" date, and continued use after that counts as acceptance.
